Official Rules
NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED. The Lucky-U Bob-B-Q Instant Win Game (the "Promotion") begins at 12:00:01 A.M. Eastern Time (ET) on Thursday May 15, 2008 and ends at 11:59:59 P.M. Eastern Time (ET) on Sunday August 31, 2008 (the “Promotion Period”). Entry in the Promotion does not constitute entry into any other promotion, sweepstakes or contest sponsored by BOB EVANS FARMS, INC. (“Sponsor”) or its affiliates. By participating in the Promotion, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and Sponsor's decisions, which decisions shall be final and binding in all respects.
- ELIGIBILITY: The Promotion is open only to legal residents of the 50 United States and the District of Columbia (includes Alaska and Hawaii) who are 18 years of age or older at the time of entry. Do not participate in the Promotion if you are not physically located in the United States at the time you enter the Promotion. The Promotion shall be governed exclusively by the federal and state laws of the United States. Employees, officers and directors of Sponsor, Bob Evans Farms Inc., Empower Media Marketing, RealTime Media, Inc. (the “Administrator”), their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies, their immediate families (including parents, children - whether step children or adoptive children or biological children, siblings, spouses and in-laws) and persons living in the same household as such individuals (whether related or not) are not eligible to participate in the Promotion. Void in Puerto Rico, all other territories and where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.
- HOW TO ENTER: LIMIT: Two (2) game plays per person and/or email address per day, regardless of entry method for the life of the promotion. To enter and play in the Promotion, visit the Promotional web site at: www.BobEvansBob-B-Q.com. Complete the entry form by entering your true, correct and complete information in all required fields, then click “Enter.” After registering you will then be presented with an interactive game play page customized with the Bob Evans Horseshoe Pit. The user will be directed to click on a horseshoe to pitch it toward the stake in the pit. To be an instant winner of a $10 Bob Evans Restaurant gift card, the user must land one (1) of two (2) horseshoes around the stake. Your horseshoe must completely surround the stake. If you're an instant winner, you will see a winner's confirmation page where you may verify that all of the information you entered on the registration page is correct. If any information you have entered is incorrect, you must send an email to BobBQ@promosupport.com so your information may be verified.
If your horseshoe does not completely surround the stake, then you will be served a page stating that you are not an instant winner. You may refer a friend(s) to the instant win game promotion through the Tell a Friend page on the promotional web site. If you enter a friend's name and valid email address, you will be given an additional game play on the promotional web site. You will be provided with a link back to the game play page for a second chance to instantly win a prize. Maximum daily games plays is contingent upon the user referring others through the Tell a Friend page.
Entrants who have previously played the instant win game and have not won will be able to enter the game play page by entering their information on the login page. First-time users who visit the site to play the game must fill out the full registration form before they will be taken to the game play page.
Any attempt by a person to use multiple email accounts to register more than once may
result in disqualification at the discretion of the judges or Sponsor upon verification of
prize winners. Only the authorized account holder of the email address at time of entry may submit an entry. In the event of a dispute regarding the identity of any potential winner, Sponsor will award the prize to the authorized account holder of the email address at time the potential winner submits the Promotion entry. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. Sponsor may require a potential winner to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry. Sponsor may disqualify the entry if the information the potential winner provides to Sponsor is not satisfactory to Sponsor. Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete garbled or corrupted are void and will not be accepted. By entering the Promotion, you agree to all of the Terms of Use and the Sponsor's Privacy Policy, which is available here.
Tell-A-Friend Program: You will be able to earn an additional game play on the promotional web site for referring a friend by providing their name and a valid email address. Users will be provided with a link back to the game play page for a second chance to instantly win a prize. Once on the Tell-A-Friend page, entrants can send an Instant Win game e-mail to their friends. Each Instant Win game e-mail will contain a link to the Instant Win game website which the recipient may click on to go to www.BobEvansBob-B-Q.com to participate in the Instant Win game. The entrant who sent the Instant Win game e-mail will receive one (1) additional Instant Win game play only; regardless of how many friends are referred to the promotion. Participants may not use the Tell-A-Friend program to send emails to themselves and may not generate additional Instant Win game entries by clicking on the Instant Win game website link contained in any Tell-A-Friend email. - INSTANT WIN GAME PRIZES AVAILABLE and OPPORTUNITITY OF WINNING:
There are a total of 658 prizes available in the Instant Win Game. Total Approximate
Retail Value of all prizes is $6,580. Odds of winning a prize in the promotion depend on the number of eligible entries received and the day and time of game play. Maximunamount of wins is based upon the following prize availability schedule: During weeks 1-4, of the promotion period, there will be 280 instant win prizes given away total. During weeks 4-8, 196 instant win prizes will be given away total. During weeks 8-12, 140 instant win prizes will be given away total. During weeks, 12-15, 42 instant win prizes will be given away total.
Quantity/Description/Approximate Retail Value: Six Hundred Eighty Five (685) $10.00 Bob Evans Restaurant Gift Cards. All gift cards are subject to the issuer's terms and conditions. - PRIZE AWARDING: LIMIT: One (1) prize per person and household. Multiple entrants are not permitted to share the same email address. Any attempt by any entrant to obtain more than the stated number of plays/entries by using multiple/different email addresses, identities, registrations and logins, or any other methods will void that entrant's plays/entries and that entrant may be disqualified. Sponsor will only award a prize after verifying the entry and the winner's information comply with these Official Rules. Winners may not request a substitute prize, request the cash equivalent of the prize, or transfer or assign their prize. All prizes will be shipped to winners 2-4 weeks after the potential winner verifies their correct information. Potential winners will be deemed an official winner after verification is complete.
- RIGHT OF PUBLICITY: Except where prohibited or restricted by law: Each winner grants Sponsor the right to use and publish winner's full name and state of residence online in connection with the Promotion; and by accepting a prize, each winner grants Sponsor and its affiliate's permission to use winner's name and likeness solely for advertising and promotional purposes as Sponsor deems appropriate without notice or further compensation.
- DISQUALIFICATION: Sponsor or the Administrator may disqualify any entrant found
tampering with or abusing any aspect of this Promotion from this Promotion and from
participating in any other current or future promotions or contests that the Sponsor or
Administrator sponsor.
If Sponsor or the Administrator disqualifies an entrant for any reason the entrant may not participate in the Promotion or claim a prize. Any attempt by any person to deliberately undermine the legitimate operation of the Promotion may violate federal or state criminal or civil law. Should any person make such an attempt, Sponsor may seek damages or other relief against such person as permitted by law. Sponsor's failure to enforce any term of these Official Rules shall not constitute a waiver of that term. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Promotion if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Promotion, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right to award the prizes in a random drawing from among the eligible, non-suspect entries received up to the time of the impairment. If for any reason more entrants receive an “instant winner” notice than the number of prizes stated herein, Sponsor reserves the right to award only the number of prizes stated in the Official Rules via a random drawing from those entrants who received an “instant winner” notice. In no event will more prizes be awarded than those listed in the Official Rules. - LIABILITY & RELEASE: By participating in the Promotion, entrants agree to release and hold harmless Sponsor, Administrator and their respective affiliates, shareholders, directors, officers, distributors, employees or agents (collectively, the (“Promotion Entities”) from and against any claims or causes of action arising out of or in connection with participating in the Promotion or receiving or using any prize, including, but not limited to: (a) unauthorized human intervention in the Promotion; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Promotion or the processing of entries; or (f) injury or damage to entrant or other persons or property which may be caused, directly or indirectly, in whole or in part, from entrant's participation in the Promotion or receipt of any prize. Entrant further agrees that in any cause of action, the Promotion Entities' liability will be limited to entrant's cost of entering and participating in the Promotion, and in no event shall the Promotion Entities be liable for entrant's attorney's fees. Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
- TAX INFORMATION; LEGAL FILINGS: All applicable federal, state, local, and other Taxes (income or otherwise) on prizes are the sole responsibility of the applicable winner. Sponsor will furnish the appropriate state agency winner's name and address and other pertinent information, if required by law.
- DISPUTES: Except where prohibited by law, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant's rights and obligations, or the rights and obligations of the Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with applicable federal and state laws and regulations. All decisions of Sponsor or Administrator shall be binding and final.
