Official Rules

No purchase necessary to enter or win. The promotion shall be construed and evaluated according to United States law. Do not participate in the promotion if you are not a legal U.S. resident. Void where prohibited.

1. Eligibility: The Comcast “African Adventure” Instant Win Game & Sweepstakes” (the “Promotion”) is only open to legal residents of the 50 United States and the District of Columbia who reside in the 50 United States and the District of Columbia (excluding Puerto Rico and all other territories and possessions) who are 18 years of age or older at the time of participation.  Potential winners may be required to provide proof of legal U.S. residency (in a form satisfactory to Sponsor) if requested by Sponsor to determine eligibility and as a condition of prize award.  Employees, agents, officers and directors of Comcast Interactive Media (“Sponsor”) and RealTime Media, Inc. (collectively, together with Sponsor, the “Promotion Entities”), and their respective parents, affiliates, subsidiaries, franchisees, divisions, advertising, promotional, fulfillment and marketing agencies (collectively, “Released Parties”), and their immediate families (parent, child, sibling or spouse and their respective spouses, regardless of where they reside) and persons living in the same households as such individuals (whether related or not) are not eligible to participate or win in the Promotion.  By participating, you agree to these Official Rules and to the decisions of the Promotion Entities whose decisions are final and binding in all respects. Void in Puerto Rico, all other territories and possessions and where prohibited by law, rule or regulation. All applicable federal, state and local laws and regulations apply.
2. How to Participate: The Promotion begins on September 2, 2008 at 12:00 P.M. Eastern Time (“ET”) and ends on November 17, 2008 at 11:59:59 P.M. ET (the "Promotion Period"). 

   To enter, visit http://go.rtm.com/comcast-net/africanadventure (the "Web Site") during the Promotion Period and click on the Comcast “African Adventure” Instant Win Game & Sweepstakes link.  There, you will be asked to register for the Promotion by entering your true and correct information on the registration form. Submit completed entry form as indicated to receive one (1) entry into the Sweepstakes and play the Instant Win Game.  

   Returning Entrants: you are only required to complete the online registration form the first time you register for the Promotion. In order to gain additional Sweepstakes entries and Instant Win game plays, return to the site and follow the links to the Log-in Page.  Limit one (1) Sweepstakes and Instant Win game play entry per person and per email address per day.  A day is understood to start at 12:00:00 a.m. ET and end at 11:59:59 p.m. ET the same day, except for the first day which for the purposes of this Promotion begins at 12:00 P.M. ET.  If you receive a winning Instant Win message, you will be sent an email prize confirmation message stating that you may have won the prize indicated in the message.  All prize awards are subject to verification of eligibility and compliance with the terms of these Official Rules.  If you receive a non-winning message on your screen, you are not a winner of an instant win prize.  Any attempt to use multiple usernames, passwords or email accounts or other tactics to register, enter or play more than the stated limits may result in the disqualification by the judges or Sponsor from the Promotion and all associated registrations, entries and/or game plays will be void.  Entries or game plays or registrations generated by script, macro or other automated means or with the intent to subvert the registration, entry or game play process may be void.

   Except as noted in these rules, information collected for this Promotion is used only for the purpose of winner notification, and will not be re-used, sold or shared in any manner by Promotion Entities or any third parties unless entrant has elected to receive additional information and promotional material from the Sponsor or a third party.  In the event of any discrepancy between the Comcast privacy policy (the “Comcast Privacy Policy”) and these Official Rules, these Official Rules shall control and govern.  By participating in the Promotion, participant agrees to all of the terms and conditions of the Comcast Privacy Policy, which is available at http://www.comcast.net/privacy.
   Registration, entries and game plays will be deemed made by the authorized account holder of the email address submitted at time of registration.  The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address.  A potential winner may be required to provide Sponsors with satisfactory proof that he/she is the authorized account holder of the email address associated with the potentially winning entry or/or game play.

3. Instant Win Game Prizes Available and Odds of Winning: A total of seven hundred and seventy (770) random, computer-generated winning times, one for each Instant Win Game Prize listed below, will be generated during the Promotion Period.  If you are the first to play the game at a randomly determined winning time, as determined and verified by Sponsor, or if no one plays at such time and you are the first to play immediately after such time, as determined and verified by Sponsor, you will receive a winning message.  Odds of winning a prize depend on the number of eligible game plays received and the date and time of game play.  The quantities, description and Approximate Retail Value (“ARV”) of each specific prize to be awarded in the Instant Win Game hereunder are as follows:

   Prizes will be awarded electronically and delivered to the email address indicated on your registration form.  The return of any prize email as undelivered or noncompliance of these rules by any winner will result in forfeiture of prize.

4. Sweepstakes Prizes, Drawings, And Odds of Winning: Each time you register and/or login, you will receive one (1) entry into the Grand Prize Sweepstakes drawing.  The potential Grand Prize winner will be selected in an electronic randomized drawing from all eligible entries received.  Odds of winning depend on the number of eligible entries received. This Sweepstakes drawing will be held on or about November 18, 2008.

   Grand Prize: One (1) Grand Prize trip for two to Africa.  The trip consists of: round trip air transportation (coach), an 11-day journey of South Africa with a guided tour of South Africa’s wine country, private game drives, 22 meals (10 breakfasts, 4 lunches, and 8 dinners), and select gratuities to local guides, hotel servants, airport transfers, and local service charges.

   Total ARV of the Grand Prize is $20,000.  Actual value may vary based on point of departure.  Any difference between stated value and actual value will not be awarded.  Trip must be taken on dates specified by Sponsor or prize will be forfeited and Sponsor will have no further obligation to such winner.  Sponsor reserves right to change dates.  Winner and guest must travel together on the same itinerary and obtaining all necessary travel documents, including visas and passports as well as all vaccinations.  Guest must be of legal age of majority in his/her jurisdiction of residence (and at least 18), unless the child or legal ward of winner and must sign a liability/publicity release prior to issuance of travel documents. If guest is child or legal ward of winner, winner must sign and return release on behalf of such child or legal ward. Travel must be made through Sponsor’s agent, on a carrier of Sponsor’s choice. Certain travel restrictions may apply. All costs and expenses associated with prize acceptance and use not specified herein as being provided, including, additional ground transportation, luggage fees, meals, souvenirs, gratuities and vaccinations are the sole responsibility of the winner.

   If scheduling conflicts, cancellations, postponement, an event of “Force Majeure”, or for any other reason Grand Prize winner cannot attend Grand Prize Trip, then in lieu of the Grand Prize Trip, the Grand Prize winner may elect to receive a twenty thousand dollar ($20,000.00) check, and such amount shall constitute full satisfaction of Sponsor’s prize obligation to such Grand Prize winner, and no other or additional compensation will be awarded.

   The Total ARV of the Promotion prizes is $35,400.

5. General Prize Restrictions: In no event will more than the number of prizes stated herein be awarded. If due to seeding, technical, electronic or other errors, the number of valid prize claims received for any prize level exceed the number of such prize set forth herein, Sponsor reserves the right to conduct a random drawing to award the stated number of prizes for the prize from among all valid and non-suspect prize claims received for such prize.  The Promotion Entities will award prizes only upon winner confirmation, verification and final approval.  Winners are responsible for all federal, state and local taxes as well as all costs and expenses associated with prize acceptance and use not specified herein as being awarded.  No substitution or transfer of any prize is permitted, except by the Promotion Entities who reserve the right, in its sole discretion, to substitute a prize (or portion thereof) of comparable or greater value.  Prizes are awarded “as is” with no warranty or guarantee, either express or implied by Sponsor.  If applicable, prize winners may receive an IRS Form 1099 for the retail value of the prize.  Any portion of a prize not accepted by winner will be forfeited.  All prize details are at Sponsor’s sole discretion.

6. Sweepstakes Prize Award: The potential Grand Prize winner may be notified by phone or e-mail and will be required to satisfactorily complete an Affidavit of Eligibility, a Liability and Publicity Release, and W9, all of which must be returned within ten (10) days of date of winner notification to RealTime Media. The potential Grand Prize winner must also demonstrate to the Promotion Entities, at least 30 days prior to trip departure, the ability to timely obtain (i) a valid U.S. passport, and (ii) all vaccinations and preventative medications required or recommended by the U.S. Department of Health and Human Services Centers for Disease Control within 30 days of the proposed trip. If potential Grand Prize winner cannot be contacted; is ineligible; fails to return the completed and executed Affidavit and Release, if the prize notification is returned undeliverable; or if the potential Grand Prize winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and the prize may be awarded to an alternate winner as selected by the Promotion Entities.

7. General: Each winner hereby expressly grants to the Promotion Entities and their respective designees all rights to use and publish his/her name, likeness (photographic or simulated), and city and state of residence for solely advertising, marketing, promotional and publicity purposes in connection with this Promotion (“Advertising”), in any and all media now or hereafter devised, worldwide in perpetuity, without any form of notice or any amount or kind of compensation or permission, except where prohibited by applicable law.  All copyright, trademark or other intellectual property rights in such Advertising shall be owned by Sponsor or its licensors and winning participants hereby disclaim and waive any claim of right to such Advertising.  Such Advertising shall be solely under control of Sponsor or its licensors, and winning recipients hereby waive any claim of control over the Advertising content as well as any possible claims of misuse of winning recipient’s name, likeness or voice under contract, tort or any other theory of law.  Winners also agree that, upon reasonable notice, they will use good faith efforts to be available to travel for the promotional purposes of Sponsor for a period of one (1) year from the end of this Promotion.  In the event any winner is required to travel, Sponsor agrees to pay all costs associated therewith.

   This Promotion is conducted in English (which will be given its everyday ordinary meaning), and any and all disputes will be resolved in accordance with the laws of the Commonwealth of Pennsylvania without regard for conflict of laws principles. 

8. Conduct: By participating in this Promotion, participants agree to be bound by these Official Rules and the decisions of the Promotion Entities which shall be final, binding and non-appealable in all respects.  The Official Rules will be posted on the Web Site throughout the Promotion Period.  Failure to comply with these Official Rules may result in disqualification.  The Promotion Entities reserve the right at their sole discretion to disqualify any individual found to be tampering with the participation process or the operation of the Promotion or the Web Site; or to be acting in any manner deemed the Promotion Entities to be in violation of the Official Rules; or to be acting in any manner deemed by the Promotion Entities to be unsportsmanlike or disruptive, or with intent to annoy, abuse, threaten or harass any other person and void all associated entries and/or game plays.  CAUTION: ANY ATTEMPT BY A USER OR ENTRANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEB SITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSORS RESERVE THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

9. Limitations Of Liability: Released Parties assume no responsibility or liability for (a) lost, late, inaccurate, incomplete, delayed, misdirected or garbled registrations, entries, game plays or emails; (b) any incorrect or inaccurate entry information, or for any faulty or failed electronic data transmissions; (c) any unauthorized access to, or theft, destruction or alteration of entries or game plays at any point in the operation of this Promotion; (d) any technical malfunction, failure, error, omission, interruption, deletion, defect, delay in operation or communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilized in any aspect of the operation of the Promotion; (e) inaccessibility or unavailability of the Internet or the Web Site or any combination thereof or for computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Promotion, including, without limitation, errors or difficulties which may occur in connection with the administration of the Promotion, the processing of entries or game plays, the announcement of the prizes, or in any Promotion-related materials; or (f) any injury or damage to participants or to any other person's computer which may be related to or resulting from any attempt to participate in the Promotion or download of any materials in the Promotion.  If, for any reason, the Promotion (or any part thereof) is not capable of running as planned for reasons which may include without limitation, infection by computer virus, tampering, unauthorized intervention, fraud, technical failures, or any other causes which may corrupt or affect the administration, security, fairness, integrity or proper conduct of this promotion, then the Promotion Entities reserve the right at their sole discretion to cancel, terminate, modify or suspend the Promotion in whole or in part.  If terminated, the Promotion Entities may, at their discretion, award the Grand Prize from among all non-suspect, eligible entries received up to time of such action.

10. Releases: All participants, as a condition of participation in this Promotion, agree to release and hold harmless Released Parties from and against any and all liability, claims or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained, in whole or in part, directly or indirectly, in connection with accessing the Web Site, participation in any aspect of the Promotion, or the receipt, ownership or use of any prize (including any travel or activity-related thereto) awarded.  

11. Grand Prize Winner’s Name: To receive the name of the Grand Prize winner send a self-addressed stamped #10 envelope for receipt by December 31, 2008 to:  Comcast “African Adventure Instant Win Game & Sweepstakes” Winner’s Name, c/o RealTime Media, Inc., 1060 First Avenue, Suite 201, King of Prussia, PA 19406.
