The Twilight Saga: New Moon Sweepstakes Official Rules

  1. NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED.  The Toys”R”Us Ultimate New Moon Sweepstakes (“Sweepstakes”) begins at 12:00:00 AM Eastern Time ("ET") on Thursday, November 5, 2009 and ends at 11:59:59 PM ET on Wednesday, November 25, 2009 (“Sweepstakes Period”). The Sweepstakes is intended for participation only in the 50 United States and the District of Columbia and shall be construed according to, and governed exclusively by the law of the State of New York and any applicable United States federal law. Do not participate in the Sweepstakes if (a) you are not physically located in and (b) a resident of one of the 50 United States or the District of Columbia at time of entry. Entry in the Sweepstakes does not constitute entry into any other Sweepstakes, Contest or Promotion. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and the decisions of Toys“R”Us - Delaware, Inc.  ("Sponsor"), which shall be final and binding in all respects.
  2. ELIGIBILITY: The Sweepstakes is open to residents of the 50 United States and the District of Columbia, who are 18 years of age or older. Employees, officers and directors of Sponsor, Summit Entertainment, LLC ("Summit") and/or RealTime Media, Inc. (collectively, “Sweepstakes Entities”), their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies, their immediate families (parent, child, sibling & spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Sweepstakes. Void outside the 50 United States and the District of Columbia. Void where prohibited or restricted by law, rule or regulation. All applicable federal, state and local laws and regulations apply. Summit is not responsible for the administration of this Sweepstakes, the collection of entries, or the selection of winners.
  3. HOW TO ENTER: Limit one (1) entry per person and/or email address for length of the Sweepstakes Period. Subsequent entries submitted by the same person and/or from the same email address will be disqualified.

    To enter the Sweepstakes, visit http://www.toysrus.com/newmoonsweeps (the "Sweepstakes Website"). You will then arrive at the Sweepstakes Details page. Click Enter Now to go to the Sweepstakes Registration page (go.rtm.com/newmoonsweeps).  Complete the entry form with your true and correct information and click the “Submit” button. After entering your registration information and clicking on the “Submit” button, you will receive one (1) Sweepstakes entry.

    The Sweepstakes Website clock will be the official timekeeper for this Sweepstakes. Entries will be deemed made by the authorized account holder of the email address submitted at time of entry. In the event of a dispute regarding the identity of any potential winner, the potential winner will be deemed to be the authorized account holder of the email address submitted at time of Sweepstakes entry. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.  If, in Sponsor’s sole determination, a dispute cannot be resolved, the entry will be deemed ineligible.  Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete garbled or corrupted are void and will not be accepted. Except as noted in these rules, information collected from entrant will be used in accordance with Sponsor's Privacy Policy, which is available here.

  4. Sweepstakes Prizes, Drawings, And Odds of Winning: An electronic randomized drawing will be held on or about Thursday, November 26, 2009 by RealTime Media, Inc., an independent judging organization, to select seven (7) Prize Winners from all eligible entries received. Eligible entries will be included in drawings unless and until an entry is drawn as a winner. Odds of winning depend on the number of eligible entries received.

    Seven (7) Prizes Are Available: Each Prize Winner (“Winners”) will receive one of the following:

    One (1) Grand Prize winner will be awarded two (2) movie set red robes worn during the Volturi scenes appearing in "The Twilight Saga: New Moon", ARV $50 each; Total ARV $100.00

    One (1) 2nd Prize winner will be awarded "The Twilight Saga: New Moon" Movie Script - signed by talent from the film, ARV $10.00

    One (1) 3rd Prize winner will be awarded one (1) "The Twilight Saga: New Moon" Movie Poster - signed by talent from the film, Approximate Retail Value (ARV) $20.00

    One (1) 4th Prize  winner will be awarded a Twilight Collector Doll Edward Cullen by Tonner Doll Company, ARV $139.99

    One (1) 5th Prize winner will be awarded a Twilight Collector Doll Bella Swan by Tonner Doll Company, ARV $139.99

    One (1) 6th Prize winner will be awarded a Barbie Collector® - Twilight Edward Doll, ARV $24.99

    One (1) 7th Prize winner will be awarded a Barbie Collector® - Twilight Bella Doll, ARV $24.99

    Total ARV of all Sweepstakes Prizes is $459.96,

    Prize Restrictions: No prize substitution, cash equivalent of prize, transfer or assignment of prize (or portion thereof) permitted, except by Sponsor in its sole discretion, or as otherwise provided herein. Sponsor reserves the right to substitute the prize (or portion thereof) with one of comparable or greater value, at its sole discretion. The difference between the ARV and actual value of the prize will not be awarded.
    The Sweepstakes Entities will award the available prizes to the Winners only upon that Winner’s confirmation, verification and final approval by Sponsor. Any portion of the prize not accepted by Winner will be forfeited.  All prize details are at Sponsor’s sole discretion.

  5. PRIZE AWARDING: Limit of one (1) prize per person, household, and/or email address. Potential Winners will receive prize notification via electronic mail and/or phone call within three (3) days after the Sweepstakes Drawing has been conducted that he/she has won and will have forty-eight (48) hours from receipt of winning notification to confirm that the notification has been received.  If a potential winning entrant cannot be contacted; is ineligible; fails to claim the prize; if the prize notification is not returned; or if the potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and the prize will be awarded to an alternate potential winner drawn during the sweepstakes drawing.

    After confirming notification receipt, the potential winners will be sent via email, United States Postal Mail and/or overnight mail an Affidavit of Eligibility/Compliance & Publicity/Liability Release forms and a W9 form. These forms must be completed, signed, notarized and returned to RealTime Media within ten (10) days. The potential Winner then and only then becomes the winner.  If the potential Winner of any prize fails to return the completed and executed Affidavit and Release; fails to claim the prize; if the official paperwork is returned undeliverable; or if the potential winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and the prize may be awarded to an alternate potential winner drawn during the sweepstakes drawing.
    Any taxes, fees, or incidental costs including but not limited to income taxes which may arise and be due or asserted on account of the prize shall be the sole responsibility of the winner.  A 1099 tax form will be the responsibility of the winner if applicable.  Winners agree that receiving a prize grants Sponsor the right to print, publish, broadcast, and use universe-wide in any media now known or later developed at any time or times, the winner's name, portrait, picture, voice, likeness, and biographical information for any purpose, including but not limited to, in advertisements, publicity, and other communications without additional compensation, except where prohibited by law.  Eligibility, age, and other claims made by Winners are subject to verification. As part of the affidavit of eligibility, each Winner agrees to irrevocably grant Sponsor the royalty-free right throughout the world to edit, modify, publish, use, reuse, not use, or otherwise exploit the any entry information, and any material based thereon or derived there from, in any manner, for any lawful purposes whatsoever, including, without limitation, for advertising and promotional purposes in any medium (whether now or hereafter known) throughout the world in perpetuity without further permission, consideration, or payment to the entrant, except where specifically prohibited by applicable law. In the event a Winner is deemed a minor under the jurisdiction of his/her state of residence, the Winner's parent or legal guardian will be required to sign and return all documents. Prize winner grants Sponsor the right to use and publish winner's proper name and state of residence online in connection with the Sweepstakes. Acceptance of a prize constitutes permission for Sponsor and its affiliates to take photographs and/or video of the prize winner, and use such photographs and/or video, along with winner's name and likeness, for any and all advertising and promotional purposes as Sponsor so determines without notice or further compensation, except where prohibited by law.  All decisions of Sponsor and Sweepstakes Entities shall be binding and final. The Sweepstakes Entities do not assume any responsibility for any disruption in the Sweepstakes caused by circumstance or other unforeseen events outside of the control of the Sweepstakes Entities. In the event there is a discrepancy or inconsistency between disclosures and other statements contained in any Sweepstakes materials and the terms and conditions of these Official Rules, these Official Rules shall prevail, govern, and control.

  6. DISQUALIFICATION: Entrants found tampering with or abusing any aspect of this Sweepstakes, as solely determined by Sweepstakes Entities, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate entrant's eligibility to participate in the Sweepstakes. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Sweepstakes if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right, but not the obligation, to award the prizes at random from among the eligible, non-suspect entries received up to the time of the impairment.

  7. LIABILITY & RELEASE: By entering this Sweepstakes, entrants and Winners: (1) agree to be bound by these Official Rules; (2) agree to release Sponsor, Summit and each of their respective parents, subsidiaries, affiliates, divisions, advertising and promotion, fulfillment and/or judging agencies, as well as the respective officers, directors and employees of each (collectively, the “Released Parties”) from any and all liability for any loss, harm, damages, costs or expenses, including without limitation property damages, personal injury and/or death arising out of participating in this Sweepstakes, or the acceptance, possession, use or misuse of any prize and claims based on publicity rights, defamation or invasion of privacy and merchandise delivery; (3) consent to the use of their entry, name, voice, picture, and likeness for advertising and promotional purposes in any medium throughout the world in perpetuity without additional compensation unless prohibited by law, (4) acknowledged that the Released Parties have neither made nor are responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to any prize, including but not limited to its quality or fitness for a particular purpose. Sponsor may discontinue this Sweepstakes at any time, and (5) agree to release and hold harmless the Released Parties, including but not limited to Toys R Us, Inc., its parents, affiliates and subsidiaries and the respective employees, officers and directors and divisions of each from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize hereunder, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or death to a person(s) or damage to property which may be result, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstake or entrants receipt, acceptance, use &/or enjoyment of any prize. In no event shall the Released Entities be liable for attorney’s fees.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

  8. GENERAL: Sponsor may terminate the Sweepstakes or decide to modify it in any manner that it deems fair and equitable to participants if it becomes aware of any occurrence that would materially affect the Sweepstakes security and fairness.  Sponsor may prohibit individuals from participating in the Sweepstakes and disqualify entries if they (1) attempt to enter the Sweepstakes through any means other than as described in these Official Rules, (2) attempt to disrupt the Sweepstakes or circumvent the terms and conditions of these Official Rules in any way or (3) repeatedly show a disregard for the Sweepstakes Official Rules or act (a) in an unsportsmanlike manner, or (b) with an intent to annoy, abuse, threaten or harass any other entrant or Sponsor.  Sponsor’s decisions with respect to the Sweepstakes are final. 

  9. TAX INFORMATION: All applicable federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winner.

  10. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Promotion or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New York, County of New York.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sweepstakes Entities in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York.

  11. WINNERS LIST: To receive the list of Sweepstakes winners, send a #10 self-addressed stamped envelope for receipt by December 28, 2009 to: The Toys”R”Us Ultimate New Moon Sweepstakes Winners List Request, C/O RealTime Media, 1060 First Ave, Ste 201, King of Prussia, PA 19406.
