Playskool Preschoolers at Play Photo Contest- Rules

NO PURCHASE OR CONSIDERATION NECESSARY TO ENTER OR WIN. A PURCHASE DOES NOT INCREASE CHANCES OF WINNING. The PLAYSKOOL “Preschoolers at Play” Photo Contest (the "Contest") begins at 12:00:00 PM (Noon) Eastern Time ("ET") on Thursday, June 12, 2008 and ends at 12:00:00 PM (Noon) ET on Friday, September 19, 2008. Sponsor’s computer is the official time keeping device for the Contest.

ELIGIBILITY: The Contest is open only to legal residents of the 50 United States and the District of Columbia residing in the 50 United States and the District of Columbia (excluding Puerto Rico and all other territories). Entrants must be 18 years of age or older at the time of Contest registration. Employees, officers and directors of Grandparents.com (“Sponsor”), Hasbro, Inc. and/or its subsidiaries, and RealTime Media, Inc. (collectively the “Contest Entities”), their respective parents, affiliates, subsidiaries, advertising, promotional, fulfillment and marketing agencies, their immediate families (parent, child, sibling or spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Contest. By entering the Contest, participants agree to release, discharge and hold harmless Contest Entities, their respective parents, affiliates, subsidiaries, agents, representatives, retailers, agencies and their respective officers, directors, employees and agents (collectively, the “Releasees”), from any and all liability, claims, losses, injuries, demands, damages, actions, and/or causes of actions whether direct or indirect, which may be due to or arise out of participation in the Contest or any portion thereof, or the acceptance, use/misuse or possession of prizes. The Official Rules and the decisions of the judges are final and binding in all respects. Void where prohibited by law, rule or regulation. All federal, state and local laws and regulations apply.
HOW TO ENTER THE CONTEST: No purchase necessary to participate. LIMIT: Limit five (5) entries per person or e-mail address, per day for the length of the Contest. Potential winners who are discovered during prize verification to have entered or attempted to enter more than is allowed by these Rules may be disqualified at the sole discretion of the judges.

There are three (3) phases to the Contest as listed below:
1. Phase 1: Contest Entry:The Contest Entry Phase begins at 12:00:00 PM (Noon) Eastern Time ("ET") on Thursday, June 12, 2008 and ends at 12:00:00 PM (Noon) ET on Friday, August 8, 2008. (“Contest Entry Period”). To submit an entry into the Contest, go to the following Web site address http://go.rtm.com/playskool and proceed to the Registration page. Once on the Registration Page, enter your true and correct information in all required fields and click on the Submit button. In order to be entered into the Contest, entrants must then submit their photo entry, along with a caption describing the photo (maximum of 100-characters). The theme of the photo and caption should be “Preschoolers At Play”. In order to be eligible to win, the child/children in the photo must be 5 years of age or younger. Once you submit your photo, your photo will be posted and will become available for voting. (See “Tell-A-Friend Program” section below). Entrants must obtain permission from the parent or legal guardian of each and every child included in submitted photo. If a parent or legal guardian did not provide permission for the use of their child’s photo and opposes the inclusion of a posted photo on the site, they can submit a request to: playskoolcontest@promosupport.com to have the photo removed immediately.
  
  Tell-A-Friend Program: Through the Tell-A-Friend program, entrants will be able to send an e-mail to notify their friends and family of their entry in the contest and invite them to vote online for their photo to be considered for a finalist position in the Contest. An e-mail will be sent to the entrant’s friends and will include a link to the entrant’s photo on the website. Once they have submitted a vote, the friends will be able to build additional support for the entrant by sending their own Tell-A-Friend e-mail to their friends and family inviting them to also view and vote for the entrant’s photo.
  
  Information regarding Submitted Photos:
  PHOTO FORMAT MUST BE IN JPG OR GIF. NOT TO EXCEED 6 MEGABYTES IN SIZE. Contest entries cannot be revised or altered once submitted. Once submitted, all submitted components become the property of the Contest Entities and will not be returned. The Contest Entities shall have the right to disqualify any entries that contain third party advertising, or depict unsafe conduct, or that the Contest Entities deem to be obscene, vulgar, sexually explicit, lewd, derogatory, defamatory, inappropriate, or otherwise not in good taste, as determined by the Contest Entities in their sole discretion.
  
  LICENSE: Entrant grants Contest Entities and their designees the right, but not the obligation to edit, remove, modify, publish, license, print, transmit, display or otherwise use the photo, the description, and all accompanying personally identifiable information entrant submits (collectively, the “Submission”), via all forms of media now known or hereafter devised (including on http://go.rtm.com/playskool), worldwide, in perpetuity, without notice to you and without compensation.
  
  WARRANTY: Entrant represents and warrants that (i) entrant’s Submission was taken by entrant, (ii) the Submission is original to entrant and does not infringe upon or otherwise violate any right of any third party, (iii) entrant has all rights necessary to submit the Submission, including all necessary authorizations and permissions from parent or legal guardian of any persons included in the Submission, (iv) the Submission will not contan any personally identifiable information for persons included in photograph (including full name, address, e-mail or phone number), (v) the Submission has not previously been published or won a prize or award, and (vi) the Submission will not include unlawful, threatening, libelous, defamatory, obscene, pornographic or other material that would violate the law, or include any advertising for third party products or services.
  
  All Submissions may be posted on the publicly accessible Contest Web site during and following the Contest. The Contest Entities are not responsible for late, lost, illegible, incomplete, stolen, garbled or misdirected entries, all of which are void, or for malfunctions of electronic equipment, computer hardware or software, for problems downloading entries or other material from the web site or other technical problems related to the web site or a contestant’s computer or server.
2. Phase 2: Finalist Judging/Selection Dates:
  All properly submitted, eligible submissions will be reviewed by a panel of judges selected by the Contest Entities. The judges may include, or consist solely of, employees and/or representatives of the Contest Entities. The judges will review all eligible entries during Phase 2: Finalist Judging/Selection Dates. Phase 2 begins at 12:00:00 PM Eastern Time ("ET") on Saturday, August 9, 2008 and ends at 12:00:00 PM ET on Tuesday, August 19, 2008.
  
  Entries that meet the eligibility criteria will be judged as follows (the “Judging Criteria”):
  - Adherence to the Theme (40%)
  - The Quality of the Photo (20%)
  - Number of Votes from the Tell-A-Friend Program (20%)
  - Submitted Caption (20%)
  The judges will select a total of six (6) entrants, whose submissions have been graded with the highest cumulative scores, as the potential finalist contestants, subject to verification of eligibility and compliance with the Official Rules.. Finalists will advance to Phase 3 of the Contest: Public Voting, where their submissions will be posted to the Contest website for the public to cast their vote for their favorite photo. Potential finalists will be required to submit to Sponsor written permission from the parent or legal guardian of each and every child included in submitted photo in order to be officially selected as a finalist. The judges reserve the right to select less than six (6) potential finalists if there are not a sufficient number of appropriate entries received to select six (6) potential finalists.
3. Phase 3: Public Voting: The Public Voting Phase begins at 12:00:00 PM Eastern Time ("ET") on Friday, August 29, 2008 and ends at 12:00:00 PM ET on Monday, September 29, 2008. LIMIT: Limit one (1) vote per person or e-mail address. To prevent tampering with voting, only two (2) votes per IP address will be counted per day. If more than two (2) people share your internet connection, two (2) people should vote per day.
  
  To submit a vote for your favorite entry (among the six (6) finalists posted on the voting page), go to the following Web site address www.grandparents.com/playskoolvote.html and click on the link “Vote Now”. Participants will be required to submit their e-mail address and click on the “Submit” button in order to vote. Once registered, participants will proceed to the Contest Voting page and will be able to submit one (1) vote for their favorite finalist photo entry.
  
  The finalist who receives the highest number of public votes will be selected as the potential Contest Grand Prize winner and the remaining 5 finalists will potentially receive the First Place Prize, subject in each case to verification of eligibility and compliance with the Official Rules.
  
  In the event of a tie at either Phase 2: The Finalist Judging Stage or Phase 3: The Public Voting Stage, the Submission which the Judges deem stronger(est) in
  "Adherence to the Theme" will be declared the potential finalist or winner. Any further ties will be broken by the Submission which the Judges deem strongest in "Quality of the Photo". The decisions of the judges are final.
CONTEST PRIZES: There will be a total of six (6) prizes awarded (upon verification of eligibility and compliance with the Official Rules).

Grand Prize (1): The Grand Prize winner will receive the following prize package: PLAYSKOOL toy package valued at $500.00. Approximate Retail Value (ARV) is $500.00;

First Place Prize (5) The five (5) First Place winners will receive a PLAYSKOOL toy package valued at $50.00, (ARV) $50.00.

The Contest Entities reserve the right to award less than six (6) prizes if there are not a sufficient number of appropriate entries received to award all available prizes.
PRIZE AWARDING: Limit: One (1) prize per household. Prizes will only be awarded upon potential winners’ verification and final approval by Contest Entities. Prior to winner confirmation, potential winner must obtain a signed release by the parent or legal guardian of the child/children shown on the winning photograph before the prize will be released. No substitution, transfer of any prize or cash alternative permitted, except by the Contest Entities who reserve the right, in their sole discretion, to substitute a prize of equal or greater value, if any prize, or any portion of any prize, becomes unavailable. Potential winning Contest entrants will receive notification that he/she has won via electronic mail or telephone or express mail and will have (10) days from receipt of winning notification to confirm that the notification has been received and to sign and return an Affidavit of Eligibility, a Liability Release and, except where prohibited by law, a Publicity Release. After confirming notification receipt and upon verification, the potential winners will be sent their prize within 6 to 8 weeks. If the potential winning entrant of any Contest Prize cannot be contacted; is ineligible; fails to claim the prize; if the Prize Notification is returned undeliverable; does not obtain a signed release by the parent or legal guardian of the child/children shown on the winning photograph; or if the potential winner fails to timely sign and return an Affidavit of Eligibility, a Liability Release and, except where prohibited by law, a Publicity Release or otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and the prize will be awarded to the runner up. Sponsor, RealTime Media, Inc., and their affiliates are not responsible for lost or misdirected prize notification to potential winners. Each winner grants Sponsor the right to use and publish winner's proper name and State of residence and to use winner's name and likeness solely for advertising and promotional and commercial purposes, without notice or further compensation, except where prohibited by law. By entering the Contest, you agree to all of the terms and conditions of the Grandparents.com Privacy Policy, which is available at http://www.grandparents.com/gp/corp/privacy.html. All information collected will be treated in a manner consistent with Sponsor’s Privacy Policy. In the event of dispute, an entry will be deemed to have been made by the authorized holder of the e-mail account at the time the entry was made. All decisions of the judges shall be binding and final.

DISQUALIFICATION: Releasees are not responsible for lost, interrupted or unavailable network server or other connections, miscommunications, failed telephone or computer or telephone transmissions or technical failure, jumbled, scrambled or misdirected transmissions, for incorrect or inaccurate entry information howsoever caused or other error of any kind whether human, mechanical or electronic. Entrants found tampering with or abusing any aspect of this Contest, as solely determined by the judges, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate entrant's eligibility to participate in the Contest. In the event this Contest is compromised by virus, bugs, unauthorized intervention or other causes beyond the control of Sponsor which, in the sole opinion of Sponsor, corrupt, or impair the administration, security, fairness or proper play of the Contest, Sponsor reserves the right at its sole discretion to suspend or terminate the Contest. In no event will more prizes be awarded than those listed in Rules #3.
TAX INFORMATION: All federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winner.
GENERAL INFORMATION: This Contest is conducted in English (which will be given its everyday ordinary meaning), and any and all disputes will be resolved in accordance with the laws of the Commonwealth of Pennsylvania without regard for conflict of laws principles.
WINNERS LIST: To receive a list of winners, send a self-addressed stamped #10 envelope (“SASE”) for receipt by November 24, 2008 to: “PLAYSKOOL “Preschoolers at Play” Photo Contest” Winners List Request, c/o RealTime Media, Ste 201, 1060 First Avenue, King of Prussia, PA 19406.
