Official Rules

NO PURCHASE NECESSARY TO ENTER OR WIN.  A PURCHASE DOES NOT INCREASE YOUR CHANCE OF WINNING. VOID WHERE PROHIBITED OR RESTRICTED. 

  1. ELIGIBILITY: The “Touch the Possibilities” Sweepstakes (“Sweepstakes”) is open to legal residents of the fifty (50) United States and the District of Columbia who are 18 years of age or older at the time of entry. Employees, officers and directors of Martha Stewart Living Omnimedia, Inc., Hewlett Packard Company, Davie Brown Entertainment and RealTime Media, Inc. (collectively, “Sweepstakes Entities”), their respective parents, affiliates, subsidiaries, divisions, advertising, promotional, fulfillment and marketing agencies, their immediate families (parent, child, sibling & spouse) and persons living in the same households as such individuals (whether related or not) are not eligible to participate in the Sweepstakes. Void outside the United States and the District of Columbia. Void where prohibited or restricted by law, rule or regulation. All applicable federal, state and local laws and regulations apply. By participating in the Sweepstakes, each entrant unconditionally accepts and agrees to comply with and abide by these Official Rules and Sponsor’s and Administrator’s decisions, which shall be final and binding in all respects.

  2. SPONSOR: Martha Stewart Living Omnimedia, Inc., 11 West 42nd Street, New York, NY 10036.  ADMINISTRATOR: RealTime Media, Inc., 1060 First Avenue, Suite 201, King of Prussia, PA 19406.

  3. TIMING: The Sweepstakes begins at 12:00:00 AM Eastern Daylight Time ("EDT") on Monday, September 15, 2008 and ends at 12:00:00 PM EDT on Wednesday, October 15, 2008 (“Sweepstakes Period”).

  4. HOW TO ENTER: During the Sweepstakes Period, visit http://www.marthastewart.com/touchsmart (the "Website"). You will then arrive at the Sweepstakes registration page.  Complete the entry form with your true and correct information and click the “Submit” button. After entering your registration information and clicking on the “Submit” button, you will receive one (1) Sweepstakes entry. LIMIT one (1) entry per person and/or email address per day. Subsequent entries from the same person and/or email address will be disqualified. For the purposes of the Sweepstakes, a day shall mean a 24-hour period, beginning at 12:00:00 AM Eastern Time (“ET”) and ending at 11:59:59 PM ET. Any attempt by a person to use multiple email accounts to enter more than once may result in disqualification at the discretion of the judges or Sponsor.

    The Website's clock will be the official timekeeper for this Sweepstakes. Entries will be deemed made by the authorized account holder of the email address submitted at time of entry. In the event of a dispute regarding the identity of any potential winner, the potential winner will be deemed to be the authorized account holder of the email address submitted at time of Sweepstakes entry. The authorized account holder is defined as the natural person who is assigned an email address by an Internet access provider, online service provider or other organization that is responsible for assigning email addresses or the domain associated with the submitted email address. A potential winner may be requested to provide the Sponsor with proof that the potential winner is the authorized account holder of the email address associated with the winning entry.  If, in Sponsor’s sole determination, a dispute cannot be resolved, the entry will be deemed ineligible.  Entries generated by a script, macro or other automated means will be disqualified. Entries that are incomplete, garbled or corrupted are void and will not be accepted. Except as noted in these rules, information collected from entrant is used only for the purpose of the prize drawing and to notify winners, and will not be re-used, sold or shared in any manner by Promotion Entities or any third parties unless entrant has elected to receive additional information and promotional material from Sponsor or a third party. Once the Promotion has ended, all information supplied by entrants will be removed from the promotion database.  In the event of any discrepancy between the privacy policy and these Official Rules, these Official Rules shall control and govern.  By entering the Sweepstakes, you agree to all of the terms and conditions of the Sponsor’s Privacy Policy, which is available at:  http://www.marthastewart.com/privacy.

  5. SWEEPSTAKES DRAWINGS: An electronic randomized drawing will be held on or about Tuesday, October 21, 2008 by Administrator, an independent judging organization, to select one (1) Grand Prize Winner and three (3) Runner-ups from all eligible entries received during the Sweepstakes Period.  Potential Winners will receive notification that he/she has won via electronic mail and/or phone. Winners will be required to sign and return an affidavit of eligibility, liability release, tax acknowledgment form and, except where prohibited by law, a publicity release and return within ten (10) business days of issuance of notification.  Noncompliance within this time period or failure of potential winner to respond after ten (10) days of notification may result in disqualification and, at Sponsor’s discretion; an alternate winner may be selected.  If the winner of any Sweepstakes prize cannot be contacted; is ineligible; fails to properly claim the prize in accordance with these Official Rules; if the prize notification/prize is returned undeliverable; or if the winner otherwise fails to fully comply with these Official Rules, he/she will forfeit that prize and an alternate Winner will be chosen from among the remaining eligible entries.   

  6. PRIZES:  

    One (1) Grand Prize Winner: Grand Prize includes one (1) HP TouchSmart PC, one (1) HP Total Care Service Plan, one (1) HP Notebook PC and one (1) HP All-in-One Printer. Approximate Retail Value (ARV) of prize is $2,740.00. The difference between the ARV and actual value of the prize will not be awarded.

    Three (3) Runner-ups:  Runner-up prize is the HP Notebook PC. Approximate Retail Value (ARV) of prize is $700.00 each. The difference between the ARV and actual value of the prize will not be awarded.

    Total ARV of all Prizes is $4,840.00.   Odds of winning depend on the number of eligible entries received. Specifics of all prizes are at the Sponsor’s sole discretion. Prizes are awarded “as is” with no warranty or guarantee, either express or implied.  Limit one (1) prize person or household. Prizes will only be awarded upon winner verification and final approval of Sponsor and its designees. No prize substitution, cash equivalent of prizes, transfer or assignment of prize permitted, except by Sponsor in its sole discretion, or as otherwise provided herein. Sponsor reserves the right to award a prize or portion thereof of equal or greater value if any prize or portion thereof becomes unavailable. Winners are responsible for all taxes and fees associated with prize receipt and/or use.

  7. GENERAL CONDITIONS: Entrants found tampering with or abusing any aspect of this Sweepstakes, as solely determined by the judges, will be disqualified. If disqualified for any of the above abuses, Sponsor reserves the right to terminate entrant's eligibility to participate in the Sweepstakes. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be in violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. Sponsor reserves the right to terminate, cancel, suspend and/or modify the Sweepstakes if any fraud, virus or other technical problem corrupts the administration, security, or proper play of the Sweepstakes, as determined by Sponsor in its sole discretion. In such event, Sponsor reserves the right, but not the obligation, to award the prizes at random from among the eligible, non-suspect entries received up to the time of the impairment.

  8. LIABILITY & RELEASE:  By participating in the Sweepstakes, entrants agree to release and hold harmless the Sweepstakes Entities from and against any claim or cause of action arising out of participation in the Sweepstakes or receipt or use of any prize, including, but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, postage-due, misdirected, or undeliverable mail; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or receipt of any prize.  Entrant further agrees that in any cause of action, the Sweepstakes Entities’ liability will be limited to the cost of entering and participating in the Sweepstakes, and in no event shall the Sweepstakes Entities be liable for attorney’s fees.  Entrant waives the right to claim any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.

  9. TAX INFORMATION: All applicable federal, state, local, and other taxes on prizes are the sole responsibility of the applicable winner.

  10. DISPUTES: Except where prohibited, entrant agrees that any and all disputes, claims and causes of action arising out of, or connected with, the Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of New York.  All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsors in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of New York, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York

  11. WINNERS LIST: To receive the list of winners, send a #10 self-addressed stamped envelope for receipt by November 15, 2008 to: Touch the Possibilities Sweepstakes Winners List Request, C/O RealTime Media, 1060 First Ave, Ste 201, King of Prussia, PA 19406.  Vermont residents do not need to affix return postage.
